There are new rules for Local Lodging When inserted in residential buildings, new Local Lodging must receive the condominiums´ authorisation to be registered. 03 Jul 2023 min de leitura Within the regulations of Mais Habitação, and according to the Socialist Party (PS) amendment proposal, new local lodgings inserted in residential buildings can only be registered with prior authorisation from the condominium, something that will give greater control over the new registrations created. "Whenever the accommodation establishment is registered in an autonomous fraction of a building under a horizontal property regime that is intended, in the constitutive title, to be a dwelling, the registration must be preceded by a decision of the condominium for a use other than the exercise of the local accommodation activity," according to the party´s proposal. As a result of this revision, whoever intends to operate local lodging must first request authorization to the condominium to change the building´s constituent title. Only then would it be permitted to provide local lodging services, but only in registrations made after the Mais Habitação Program went into effect. The goal of this policy is to respond to the Supreme Court of Justice´s ruling, which declared the restriction of this activity in housing-related structures, leaving the discretion to give new licenses to condominium assemblies. According to the Government´s proposals, it is also intended to suspend the issuance of new local lodging licences, with the exception of rural regions.
